Fuzzy x Albertsons Offer

The Fuzzy Pet Health, Inc., (“Fuzzy”) Terms and Conditions and Privacy Policy apply for all Fuzzy memberships, data collection and sharing, and use of the Fuzzy app or website. The Albertsons Companies, Inc. Terms of Use, [banner] for U™ program terms, and Privacy Policy apply for all promotions, Credits, and use of the ACI app or website

General Terms

In addition to the Privacy Policy and Terms and Conditions of Fuzzy and ACI, the Terms and Conditions listed below apply to each promotion and/or Credit as indicated.

Initial Promotion

Initial Promotional Period:

The Initial Promotional Period (“Initial Promotional Period”) shall commence on March 29, 2022, and continue for a period of six weeks, terminating on March 31, 2023.

Initial Promotional Offer Eligibility:

During the Initial Promotional Offer Period:

(a) Fuzzy Membership Promotion. To qualify for and receive a discount on the annual membership fee with Fuzzy (“Initial Promotion”), you must meet the requirements indicated below. You must complete sign up for a new Fuzzy account through the Fuzzy app or www.yourfuzzy.com (“New Subscriber”) with a valid form of accepted payment to take advantage of the Initial Promotion. You will not be entitled to receive the Initial Promotion if Fuzzy has a record of their name, email, phone number, or credit card is linked to an existing active or inactive Fuzzy account or otherwise where Fuzzy suspects fraudulent activity. Initial Promotion cannot be redeemed for cash or cash equivalent. Initial Promotion is not transferable and may not be auctioned, traded, copied, transferred, bartered, modified or sold. Initial Promotion cannot be applied retroactively for prior purchases. Initial Promotion cannot be combined unless otherwise indicated. Terms are subject to change by Fuzzy at any time. Fuzzy reserves the right to modify or cancel the Initial Promotion at any time. Void where restricted or prohibited by law. Fuzzy’s computer is the official date/time-keeping device for Initial Promotion. You are responsible for paying any applicable sales tax related to the use of the Initial Promotion; Fuzzy has no obligation for payment of any tax in conjunction with the distribution or use of the Initial Promotion.

(b) ACI Monthly Credits. To qualify for and receive a $10 monthly credit (“Credit”), you must be a New Subscriber to Fuzzy, and have a Loyalty Account with one of ACI’s banner stores namely, Acme, Albertsons, Balducci’s, Jewel-Osco, Kings Food Markets, Pavilions, Randalls, Safeway, Shaw’s, Star Market, Tom Thumb, and Vons. A “Loyalty Account” refers to ACI’s loyalty program for its banner stores under the name of “banner 4 U™” where such program carries the name of each grocery banner store such as Albertsons 4 U™ or Safeway 4 U™. If you are eligible to receive the Credit, you will start receiving the first Credit within 2 weeks after you become a New Subscriber with Fuzzy. The Credit will be available as a clippable digital coupon in your Loyalty Account each calendar month, for up to 12 months, unless your subscription with Fuzzy is terminated. Your Loyalty Account and use of the Credit/digital coupon is subject to ACI’s for U™ Program Terms and Privacy Policy. Credit cannot be redeemed for cash or cash equivalent. Credit is not transferable and may not be auctioned, traded, copied, transferred, bartered, modified or sold. Credit cannot be applied retroactively for prior purchases. Credit cannot be combined with other offers or coupons unless otherwise indicated. Terms are subject to change by ACI at any time. ACI reserves the right to modify or cancel the Credit at any time. Void where restricted or prohibited by law.

California Promotion

California Promotion Period:

The California Promotional Period (“California Promotional Period”) shall commence on June 5, 2022, and continue for a period of fourteen weeks, terminating on August 16, 2022.

California Promotional Offer Eligibility:

During the California Promotional Period to qualify for the Promotion, you must be a resident of California at the time of acceptance of the California Promotion.

(a) To qualify for and receive the promotion (collectively “California Promotion”), you must meet the requirements indicated below . You must complete sign up for a new Fuzzy account through the Fuzzy app or www.yourfuzzy.com (“New Subscriber”) with a valid form of accepted payment to take advantage of the California Promotion. You will not be entitled to receive the California Promotion if Fuzzy has a record of their name, email, phone number, or credit card is linked to an existing active or inactive Fuzzy account or otherwise where Fuzzy suspects fraudulent activity. Promotional Period

The Promotional Period (“Promotional Period”) shall commence on August 14, 2022, and continue for a period of one year, terminating on August 16, 2023.

Promotional Eligibility:

During the Promotional Period to qualify for and receive the Promotion you must be a resident of the United States at the time of acceptance of the Promotion.

(a) To qualify for and receive The Promotion (collectively “Promotion”), you must meet the requirements indicated, as applicable, in the Promotion, and those listed below. Customers must complete sign up for a new Fuzzy account through the Fuzzy app or www.yourfuzzy.com (“New Subscriber”) with a valid form of accepted payment to take advantage of the Promotion. You will not be entitled to receive the Promotion if Fuzzy has a record of their name, email, phone number, or credit card is linked to an existing active or inactive Fuzzy account or otherwise where Fuzzy suspects fraudulent activity. Use of Credit Terms and Conditions:

Credit may only be used on pet supplies and products when you spend $10 or more on qualifying purchases in a single in-store or online transaction using your Loyalty Account. Credit expires at the end of the following month in which they were issued (i.e. if your Credit was issued in January, it will expire at the end of February). Credit is valid at any ACI banner stores – see list of banner stores here. Minimum spend is calculated after deduction of all promotions, offers, discounts, and savings. Qualifying purchases are limited to pet supplies and products, excluding prescription pet medications. Credit does not apply to orders fulfilled by a third party delivery service provider like Instacart. Online orders require a minimum purchase. Limit one Credit issued per household per month. If you have Credits available, you may use up to 2 Credits per month. See digital coupon for ACI’s general terms and conditions for additional terms on use of coupons.

Termination

New Subscriber agrees to maintain their Fuzzy account in good standing for a period of 1 year from the date of sign-up. If New Subscriber cancels their Fuzzy account within the first year, this promotion is deemed terminated by the customer no new Credits will be issued.

New Fuzzy Subscriber Promotion

Promotion is for a customer who is new to Fuzzy to (a) become a New Subscriber for the discounted price of forty-nine dollars ($49) for the first year, and (b) receive ten dollars ($10) in Credit from ACI monthly for a period of 12 months from date of signup. Fuzzy Memberships will automatically renew one year after becoming a New Subscriber for an additional year at a renewal price to be determined by the company at the time of renewal. Credit from ACI will be delivered to the New Subscriber’s Loyalty Account with the applicable ACI banner store. Customers must have a valid Loyalty Account to receive the credit each month. Active credits must be used through the end of the following calendar month from the date of issue. Only one Credit may be used per calendar month.
